Please read the following then click the 'Accept' button at the
bottom of the page. Whereby the following terms and conditions are agreed. The Talkback
service is provided by First National Telecom Services, hereafter
referred to as FNTS.
1 First National Telecom Services Limited (FNTS) shall issue the account
number/pin number and access number to the person applying for the
service. (The Account Holder).
2 The account will operate on a ‘prepaid’ basis, minimum pre-payment
£20. All prepaid amounts will be entered into the account and each call
will be deducted from the credit balance.
3 When the account is within £5 of a zero balance, or goes into a
negative balance situation before the next payment is taken, FNTS will
automatically make another charge to the Account Holder’s credit card.
This amount will be credited into the account. If the Account Holder
does not want an automatic top-up, they will notify FNTS in writing that
they require manually authorised charges only.
4 The Account Holder shall not disclose the account number/pin
number/access number to any other person.
5 The Account Holder will immediately notify FNTS verbally on becoming
aware that account number/access number or pin number has been lost or
stolen, or has been or is likely to be put to an unauthorised use and
confirm the same in writing to FNTS within 24 hours.
6 The Account Holder shall be responsible for all calls made through the
account, and charged in accordance with our call records.
7 The Account Holder will undertake to protect FNTS against all
liabilities, claims, damages, losses and expenses arising from any
breach of the Agreement.
8 The Account Holder agrees not to use the service to transmit any
material which may be abusive, offensive, obscene, indecent, menacing,
defamatory, or which might cause annoyance, inconvenience or needless
anxiety to anyone, or to commit a fraud or other criminal offence.
9 The Account Holder will notify FNTS of any change of address or change
in credit card details.
10 The Account Holder may close the account at any time. This must be
confirmed in writing within 7 days of the verbal instruction.
11 If this Agreement is terminated by either party hereto, the Account
Holder shall:
(a) pay to FNTS all arrears of charges payable under this Agreement up
to the date of termination, and
(b) immediately cease to make use of the service.
12 FNTS shall be entitled to alter any Pin or Access number(s) or any
other Account Holder specific name, number or code as may be issued by
FNTS from time to time to the Account Holder and/or the User(s) for use
with the service.
13 FNTS reserves the right to vary any rates without prior notice.
14 FNTS reserves the right to close any account, if such account has not
been used for a period of one year or more or in the event of breach of
this Agreement, without prior notice.
15 FNTS reserves the right to suspend any account if a dispute arises
and until any dispute is resolved.
16 FNTS reserves the right to terminate the Agreement forthwith if the
Account Holder fails to make payment when it becomes due.
17 FNTS shall not be liable to the Account Holder, if it is in any way
unable to provide the service for reasons beyond its control.
18 FNTS shall not in any way be liable for any direct, indirect or
consequential loss including, without limitation, loss of profit, costs,
damages and other liabilities of whatsoever nature arising from its
provision of the service or its failure to provide the service to the
Account Holder.
19 FNTS will supply the Account Holder with a detailed monthly call
usage report on request.
20 Use of the service constitutes acceptance of the FNTS Terms &
Conditions.
21 Customers will be able to make use of FNTS’ International toll-free
access numbers. There is a surcharge for using these access numbers
which will be levied against the Account Holder’s account.
22 The Agreement shall be governed by and construed in all respects
according to English Law. The parties shall submit to the exclusive
jurisdiction of the English Courts.
